You can tell that the lawyers who've come to the aid of DOJ's al Qaeda lawyers don't have a coherent case. Every time they open their mouths, they embarrass themselves.

First there was the comparison of lawyers who took up the enemy's cause to John Adams. As Cesar Conda aptly put it earlier today, that comparison is ludicrous. The United States was not at war at the time of the Boston massacre, the British soldiers Adams agreed to represent were not uniniformed terrorists, and those soldiers were defendants in a criminal trial. No one is claiming that defendants in a criminal trial are not entitled to counsel or that those who defend them are not performing a constitutionally valuable function.

But the al Qaeda terrorists are at war with the United States, and they do not have a right to counsel to challenge their status as detainees. On that score, here comes Sen. Lindsey Graham again (italics mine):

I've been a military lawyer for almost 30 years, I represented people as a defense attorney in the military that were charged with some pretty horrific acts, and I gave them my all[.]... This system of justice that we're so proud of in America requires the unpopular to have an advocate and every time a defense lawyer fights to make the government do their job, that defense lawyer has made us all safer.

This is specious. "The unpopular" are not "required" to have "an advocate" if (a) "the unpopular" include war prisoners seeking to challenge their status as enemy combatants (or unprivileged belligerents) and (b) by "advocate," Graham means a lawyer. In fact, Sen. Graham was a sponsor of the Military Commissions Act which not only endorsed a system that did not provide counsel for detainees but further (and quite properly) sought to deny those detainees access to the federal district courts.

Is Graham now saying he favors a Sixth Amendment right to counsel for all detainees seeking to challenge our military's designation of them as enemy combatants? That would be radical and unprecedented extension of constitutional rights for our alien enemies, but that sure seems to be what he's saying.

And every time a defense lawyer fights to make the government do their job, that defense lawyer has made us all safer? It did not used to be part of the government's job to explain to a court why it was holding an enemy prisoner during wartime. As Justice Jackson wrote for the Supreme Court in the Eisentrager case, giving our enemies access to our courts in order to make such a demand

would diminish the prestige of our commanders, not only with enemies but with wavering neutrals. It would be difficult to devise more effective fettering of a field commander than to allow the very enemies he is ordered to reduce to submission to call him to account in his own civil courts and divert his efforts and attention from the military offensive abroad to the legal defensive at home.

Does Sen. Graham now think the Supreme Court was wrong about that? Justice Jackson's point was precisely the opposite of what Graham argues. Allowing these claims makes us less safe. On the theory that a lawyer can be expected to argue the claim more compellingly than would a terrorist untrained in the law, the lawyer making the claim makes us less safe still.

We are not talking about criminal defendants. Of course lawyers who take the cases of criminal defendants "give their all" -- that's their obligation and they are performing a constitutionally required function. But the lawyers who represented the detainees seeking to challenge their status were not representing people who were entitled to counsel and were pushing for the creation of a legal claim that the Eisentrager Court correctly reasoned would endanger the war effort and the country. If I am remembering correctly, that was Sen. Graham's position, too ... until about five minutes ago.

Speaking of which, it seems like only yesterday that Sen. Graham was railing against the al Qaeda lawyers in a Senate debate. He didn't seem to think they were making us safer by making the government do its job. Here he was in the debate over the Military Commissions Act, complaining about the Supreme Court's Rasul case which, against the wisdom of Eisentrager, gave the detainees the right to file habeas corpus suits in federal court. Graham was complaining that this resulted in lawyers intruding into the collection of intelligence:

If I could add one thing on this point: perhaps the best evidence that the current Rasul system undermines effective interrogation is that even the detainees’ lawyers are bragging about their lawsuits’ having that effect. Michael Ratner, a lawyer who has filed lawsuits on behalf of numerous enemy combatants held at Guantanamo Bay, boasted in a recent magazine interview about how he has made it harder for the military to do its job. He particularly emphasized that the litigation interferes with interrogation of enemy combatants:

The litigation is brutal [for the United States]. We have over one hundred lawyers now from big and small firms working to represent these detainees. Every time an attorney goes down there, it makes it that much harder [for the U.S. military] to do what they’re doing. You can’t run an interrogation … with attorneys. What are they going to do now that we’re getting court orders to get more lawyers down there?

When suits for the detainees -- oh, I'm sorry, I mean, when not being a good defense lawyer who fights to make the government do their job -- Michael Ratner of the neocommunist Center for Constitutional Rights runs around Europe trying to find some court willing to indict Bush administration officials for war crimes. Now, he's John Adams. Who knew?

There would seem to be a disconnect in the headline, no? If John Wall was outstanding enough to merit player of the year honors, he was obviously the best freshman on his own team. Except... DeMarcus Cousins won it.

Hmm.

Interesting way to play it, SEC voters. I guess it makes sense. By giving the freshman honor to Cousins, the voters can recognize his excellent season, while at the same time showering praise on Wall. Everyone wins.

Except basic logic, of course. And while we're talking about disregarding logic, we may as well confront the elephant in the room: Is DeMarcus Cousins better than John Wall? That's what this is really about. While most of the nation has spent the year heaping praise on John Wall, there's a small fraction of fans and journalists that think DeMarcus Cousins is underrated. Hence the Freshman of the Year award. But let's get this straight.

DeMarcus Cousins is properly rated. Very good player, can dominate games for long stretches, and probably the most imposing low post player in the country. But he plays for about half the game, disappears for long stretches, benefits greatly from playing next to Patrick Patterson, and with a backcourt that features two point guards to get him the ball.

John Wall plays 35 minutes-a-game; Cousins plays 22 and frequently finds himself in foul trouble. Wall makes Kentucky a national title contender, whereas Cousins' mercurial history makes you wonder about their chances. Wall, the second SEC freshman to win player of the year since LSU's Chris Jackson, is worthy of the comparison to one of the best players in college basketball history. Cousins reminds people of Michael Beasley. Again, properly rated.

Very good player, but not on Wall's level, and regardless of the ambiguities that may emerge from the award season, he's nowhere near as valuable to Kentucky.

The Obama administration has made
very clear that they want Congress, rather than EPA, to take the lead in
creating a national response to climate change. Despite their oft-repeated preference for congressional action,
recently, EPA head Lisa Jackson had to once again reiterate that the agency had no plans to do a carbon cap.

There is some irony in members of
Congress worrying about what EPA is up to when their time might be better spent
putting a law together themselves.

Under existing law, it is possible
for EPA to create an economy-wide price on carbon. The Clean Air Act gives the agency broad
authority to regulate pollutants deemed harmful to the health and safety of the
population, and there are several routes EPA could take to create a national cap-and-trade, even
potentially setting up allowance auctions and going through states to refund
the profits back to American taxpayers.

But going down this road has many
downsides. First, (apologies to Paul
Thomas Anderson) there will be lawsuits.
Even if EPA uses cap-and-trade to keep the costs of regulation down, certain
industry groups will be in court before the ink
is dry on the new rule. And even if
courts ultimately side with EPA, these lawsuits will succeed in slowing down
progress.

The second problem is the threat of a
new president coming in and dismantling the system. Anything that Obama does can be undone by a
future administration-either directly or through a lack of budget support and
enforcement.

Running carbon pricing through EPA is
also a little more unwieldy than it could be if structured by smart legislative
action. Regulators would have to
jury-rig an auction system, possibly needing to enlist the help of the
states. Command-and-control mandates
under the Clean Air Act would stand, potentially hindering the efficiency of
the program.

There is also a small “d” democratic
issue. Controlling America’s greenhouse gases will
take a massive economy-wide effort and there is a legitimate benefit in having
the issue hashed out in the legislature by elected officials. That is not necessarily to say that the
legislature will arrive at a better plan than regulators, but a new law passed
by Congress and signed by the president would have a have a stronger democratic
imprimatur than an EPA regulation.

But if Congress cannot get its act
together, a Plan B of EPA action would not be so bad. If the regulation is well-designed and
justified according to the letter of the law, it will be better able to
overcome legal challenge. Auctioning
permits and sending a monthly refund check to taxpayers would build broad based
public support for the program, buffering it from the winds of change in the
White House. While running cap-and-trade
through EPA is not preferable, it is clearly better than infinite delay in
Congress.

There is still time and a glimmer of
hope for a climate bill has
been rekindled.
But if it doesn’t pass, the world’s eyes will turn to EPA with hope that
they are prepared to pick up the slack.
With that in mind, legislators’ best strategy for fending off a more
active regulatory agency is to get to work and pass a bill themselves.

In the Global Knowledge/TechRepublic 2010 Salary Survey, conducted at the end of last year, one of the questions put to respondents was “What skill set will your company be looking to add in 2010?” The skills listed by respondents include perennial favourites: security, network administration & Windows administration. Also included are virtualization/cloud computing & Web development. Meanwhile, an old favourite, business analysis, makes a comeback. Here’s the complete list, with the No. 1 skill listed being in the highest demand. 1) PROJECT MANAGEMENT: As we emerge from the recession, organizations aren’t likely to go back to the go-go days of throwing money at IT initiatives or taking risks & deploying without careful thought & planning. Organizations are putting pressure on IT to only implement projects that can show real return-on-investment. The first step to achieving a good ROI is professional project planning & implementation. Project management skills often appear in top ten skills lists, perhaps because some organizations got their fingers burnt in the 1990s through poor implementation of IT projects such as enterprise resource planning initiatives. But even though the profession is mature (in IT terms), project managers still have work to do to advance their status within organizations. According to an article on the Project Management Institute Website, project managers still have to develop their people skills, organizational leadership & individual professionalism. 2) SECURITY: It’s a never-ending game of cat & mouse for security professionals & 2009 proved to be another fun filled year. According to Symnatec’s Security & Storage Trends To Watch report, the number of spam messages containing malware increased nine-fold to represent more than 2% of e-mails, while other criminals manipulated people’s love of social networking sites to launch attacks. It’s the second most sought after skill in the Global Knowledge survey & it will be the top skill sought by CIOs in the first quarter of 2010, according to a survey of IT chiefs by Robert Half Technology. In 2010, organizations are expected to upgrade to Windows Server 2008 R2 & the Windows 7 client & perhaps install Exchange Server 2010 & SharePoint 2010. Enterprises are going to need network administrators to ensure network traffic continues to move without a hitch. Meanwhile, Cisco hopes to push more data-intensive traffic onto corporate networks. Video is a key focus for Cisco in 2010 as it works to finalize its control of video conferencing maker Tandberg & through its 2009 purchase of Pure Digital, developer of the Flip video camera. At the end of last year, Cisco introduced two TelePresence certifications: the Cisco TelePresence Solutions Specialist for midcareer voice or networking engineers seeking to specialize in the planning, design & implementation of Cisco TelePresence & TelePresence Installation Specialist aimed at installation technicians. 4) VIRTUALIZATION – CLOUD: The projected cost savings & efficiencies are no-brainers for organizations seeking to implement virtualization & cloud computing. With the cloud computing space now taking shape, it’s difficult for enterprises to find pros with substantial relevant experience. Instead, companies are drawing expertise from a range of IT skill sets, including storage, networks & desktop, according to a Network World article. Initially, companies will set up cross-functional teams to buy & develop virtualization but eventually cloud computing will be an expected skill of systems administrators. In a few years, it could even be a standard skill set of all IT pros because it touches different aspects of IT. Annual salaries average around $ 75,000 with enterprise & transition analysts earning more, Barret says. 6) BUSINESS PROCESS IMPROVEMENT: With project management & business analysis skills appearing in the skills list, it’s no surprise that business process improvement skill is also here. Business process improvement & business analysis identify areas for improvements to business processes while business process improvement or management pros use BPM techniques & technologies to help companies optimize their business processes. A recent BPM survey by IT researchers, the Aberdeen Group says the top reasons business are driving BPM activity are the need to reduce operating costs & to improve cash flow. However, the top barrier to adoption was the lack of knowledge about BPM. According to Gartner, among the competencies required for successful BPM initiatives include process skills, tools & process assets and transformation skills. In just a few short months, Farmville’s popularity has spread across the globe as Facebook fans tend to their farms & purchase virtual goods. The game, including other by Farmville developer Zynga, has netted the start-up more than 200 million monthly unique users for its online apps. One financial analyst reckons Zynga could be valued at $ 1 billion if it were to go IPO in mid-2010. Developing Facebook games is just one extreme of the vast Web development spectrum. Building iPhone could also be very profitable, writes Web developer & blogger Glen Stansberry. As moderator of the Freelance Switch job board, Stansberry listed other popular Web development skills including Framework knowledge, widget development, content management system customizations (for small businesses looking to create a unique look to their standard WordPress & Drupal blogs) & Javascript Plugin creation. DATABASE MANAGEMENT: Databases are the hearts of key business systems that drive payroll, manufacturing, sales, transaction processing & more. Programmers must be able to build programs that quickly & efficiently interface with the database management system (DBMS), while database administrators “must be able to bring the full power of databse features to bear on business problems”, writes Oracle & IBM certified DBA Howard Fosdick in his whitepaper Database Skills Availability: Critical to Your Selection of Database. “DBA expertise can be the Achilles’ heel of databse projects – many IT projects have failed due to the inability to secure DBA talent or successfully address DBA issues,” he adds. The major database vendors are Oracle, IBM & Sybase. Oracle runs three main certification programs for database professionals. Oracle Certified Associate is the first rung of the Oracle certification ladder. Next is the flagship Oracle Certified Professional (OCP) credential which certifies an individual’s ability to manage, develop or implement enterprise-wide databases & other software. Oracle Certified Master (OCM) is Oracle’s most advanced accreditation. IBM offers a dizzying array of certifications surrounding its DB2 product series. In a November blog posting in Microsoft’s Born to Learn blog, the company wrote that the first of its Windows 2008 virtualization exams would be entering beta soon. The exams will cover virtualization, desktop virtualization & virtualization administration. Windows 7 pros can certify as MCTS: Windows 7 Configuration & MCITP: Enterprise Desktop Administrator 7. 10) DESKTOP SUPPORT: Our recent article “Top Certifications in Demand Today” listed desktop support as a hot skill. In Global Knowledge’s 2010 salary survey, it was named as the 10th most sought-after skill this year. In the June article, we quoted Robert Half Technology Executive Director Dave Willmer saying that businesses will need desktop support personnel to support new workers as organizations begin hiring as the economy improves. The introduction of Windows 7 is also expected to generate additional interest. Microsoft currently provides the MCITP: Customer Support Technician & MCITP: Enterprise Support Technician certifications. but they are based on Windows Vista. • Who is Elinor Burkett and why was she allowed to be out in public?

Some of my thoughts are, perhaps, more unique to that of a creativity researcher:

I've always liked Michael Giacchino, composer of Pixar movies and Lost; now, I love him. In a brief speech, he articulated nearly everything I know about how to encourage creativity:

When I was nine and I asked my dad, "Can I have your movie camera? That old, wind-up 8 millimeter camera that was in your drawer?" And he goes, "Sure, take it." And I took it and I started making movies with it and I started being as creative as I could, and never once in my life did my parents ever say, "What you're doing is a waste of time." Never. And I grew up, I had teachers, I had colleagues, I had people that I worked with all through my life who always told me what you're doing is not a waste of time. So that was normal to me that it was OK to do that. I know there are kids out there that don't have that support system so if you're out there and you're listening, listen to me: If you want to be creative, get out there and do it. It's not a waste of time. Do it. OK? Thank you.

Yes! How do we nurture creativity? We allow mini-c (the initial creativity inherent in the learning process) flourish. We allow an environment to be psychologically "safe" from judgment and discouragement. We encourage people to pursue what they love.

And if we're lucky, we get a Michael Giacchino.

More thoughts: If anyone gets discouraged about their creative progress in their careers, take heart from Mauro Fiore. The cinematographer won the Academy Award for his work on Avatar. Twenty years ago, Fiore was the key grip (i.e., camera placement/rigging) for Stripped to Kill II: Live Girls and Saturday the 14th Strikes Back. These films were not just truly horrible films - they were also sequels to truly horrible films.

Consistent with the general research indicating that it takes ten years to become an expert in an area, Fiore worked on Schindler's List (as a gaffer, in charge of the electric work) in 1993 and then advanced to be a cinematographer on a successful televisions how (Tracey Takes On). Consistent with research I did with fellow PT blogger Scott Barry Kaufman, Fiore illustrates that if it takes ten years or so to make a professional contribution to a field, it takes about ten more years to make a truly outstanding mark. After twelve years of being a cinematographer on such movies as Training Day, Smokin' Aces, and Tears from the Sun, Fiore reached his (likely) peak with his brilliant, Oscar-winning work on Avatar.

What does this mean? It takes time to become an "expert" in a field and even longer to reach a level of "greatness." It's okay to not be a superstar yet. Even Chaucer started small (indeed, his first story was supposedly called Strypped to Kille: The Miller's Wife Returnes).

Thirdly: One of my frequent topics to write/talk/think about is the idea of creativity across domains. Is creativity one thing or many things? Even with a broad domain (such as acting), there are still nuances (which, which John Baer, I have expanded into the Amusement Park Theory of Creativity). For example, acting in movies does not necessarily mean the same thing as acting on television. One striking illustration can be found in examining which people were ignored for the Oscar memorial segment. Notable omissions include television superstars Bea Arthur, Farrah Fawcett, Ed McMahon, and Ricardo Montalban. All four made movies, ranging from the outstanding (Fawcett's The Apostle's Wife) to popular (Montalban's Naked Gun and Spy Kids 2 and 3) to the regrettable (Arthur's Mame) to the completely obscure (McMahon's The Vegas Connection). All four are obviously much better known for their contribution to television (and all will likely get special tributes at the Emmy's). This feeling that those with major acclaim in television and minor acclaim in film do not deserve a tribute at the Oscar's may illustrate a strongly domain-specific point of view. Of course, they did honor Michael Jackson, who appeared in The Wiz and little else.

Fans have been commenting extensively about the omissions (especially Fawcett). Some of this anger has taken the form of criticizing other memorial inclusions, such as the writers/directors/behind the scenes people (such as Tullio Pinelli, Ken Annakin, Daniel Melnick, and Gareth Wigan). Such comparisons hint at the differences between how novices and experts perceive the movies. One message board poster wrote - and I quote - "Too much focus on the 'behind-the-scenes' people. People don't want movies for the writing or directing." Clearly, most expert moviemakers and movie connoisseurs would acknowledge the small contributions of folks like Spielberg, Hitchcock, and Scorsese.

Finally, I noted Howard Stern's reactions to best actress nominee Gabourey Sidibe. In his typically antisocial manner, he delivered a wide array of insults. These ranged from racial/sexist humor ("the most enormous, fat black chick I've ever seen") to mock sympathy ("You feel bad because everyone pretends that she's part of show business and she's never going to be in another movie") to crude humor ("What movie is she going to be in? ‘Blind Side 2,' she could be the football player") to supposed advice ("You just want to say to her, listen, honey, now that you've got a little money in the bank go get yourself thin, because you're going to die in three years"). Reactions have been varied, with some people voicing agreement and most expressing disgust, shock, and anger.

Why does Stern say these sorts of things? One reason is that it gets the desired results - it gets him attention. There is actually some scientific evidence of this phenomenon - three researchers studied shocking content in social appeal (i.e., HIV/AIDS prevention) advertising. They found that people shown the shocking ads remembered them better, paid more attention, and were more likely to change their behavior. Obviously, these are different contexts, but it may be that Stern is going to continue to get exactly what he wants from his antisocial comments.

How will Sidibe react? One interesting study looked at the role of honor and how it impacts a person's response to an insult. For both honor-driven (i.e., collectivist) societies and non-honor-driven (i.e., individualistic) societies, anger is a more likely response than shame. When someone is angry after an insult, they typically have a desire to punish the insulting person. This feeling can result in a verbal attack (i.e., insulting the person back) or giving verbal disapproval. Shame can also lead to verbal disapproval, but it can also lead to withdrawal (doing nothing). Honor cultures tend to verbally disapprove more; non-honor cultures tend to withdraw. In part, this tendency is because shame is seen as an embarrassing thing in non-honor cultures.

None of this, of course, changes the fact that Stern is an ass.

Tuesday (March 9) is a day not to mourn, but to celebrate the life and legacy of one of music's most gifted artists: the Notorious B.I.G.

His voice, his flow, his rhymes, his swag — whatever you wanted, B.I.G. had it to offer. He could tell stories, battle it out, ignite the party or kick game to the ladies. Christopher Wallace was made for rap.

We didn't get much time with Biggie. He put out his first album in 1994, and he died in early 1997 before the release of his second LP (Life After Death). Due to his work ethic, however, we have a catalog of timeless music that is often imitated, never duplicated. As mesmerizing as a Biggie song was, part of his allure as an artist was his charming personality. He's a rare breed that could capture the wit and magnetism in his offstage persona and bring it to his music.

Here, we are taking you back into our vaults to relive Biggie's best MTV interviews. He was candid and thoughtful as he spoke about the inspiration for his music, his stage performance and much more.

On Tuesday night, Diddy is going to celebrate the life of his friend and marquee artist at Brooklyn club the Lab.

"We're trying to make March 9th a national hip-hop holiday," Diddy told MTV News last week. "It already is, on the low. MTV is going to have a big special. We're doing a party. I'm going to Brooklyn. It's gonna be the first time I'm throwing a party in Brooklyn. I'm from Harlem. Everybody in Harlem knows you don't usually go over the bridge to Brooklyn. It's a big, big deal. Me being such a Harlemite, I'm going over there to pay respect to my man. It's gonna be a big party in Brooklyn with Mister Cee. It's a big day. It's a day to celebrate his life. It's a day to celebrate the life of the man. We done did the movie, the records. It's something that, I guess, as a label we're obsessed with: making sure people don't forget about this man in a positive way. March 9 is Biggie Day. ... On Tuesday, MTV Jams will be playing videos by B.I.G. and a slew of other fallen musical soldiers, such as Michael Jackson, Tupac Shakur, Aaliyah, Big Pun, the Lost Boyz and their deceased member Freaky Tah and Camoflauge. This week's "Sucker Free Sunday" on MTV2 is running a special tribute to Biggie, hosted by Diddy.

You all knew I would weigh in on the Eagles' biggest offseason story eventually, right?

Well, much like the team, I've taken my time.

See, the Eagles seem content to go into 2010 with three quarterbacks all in the final year of their contracts. Apparently, what some see as a circus, they see as a minute detail.

But allow me to play devil’s advocate for a moment and say this: If one bird has to have his wings clipped, wouldn’t it make the most sense for it to be the biggest?

Yes, that may sound like blasphemy. Heck, as a fan, I don’t even want to say it—Donovan McNabb’s No. 5 was only the second Eagles jersey I ever purchased, and of the four I count in my closet today, his is the only one that is not yet a throwback.

But it’s time for the Philadelphia Eagles’ offense to grow, instead of growing old.

And for that to happen optimally, McNabb would have to be out of the picture.

This isn’t a similar situation to Brian Westbrook, or even to Brian Dawkins. McNabb can clearly still play at a high level, and any move that results in him no longer being an Eagle wouldn’t be a huge surprise.

No, it’s more about turning the corner.

Forget the arguments that the team is “stagnant” or that McNabb has never won anything. Neither did Dan Marino, but the Dolphins stuck with him until he could barely walk because they knew he gave them the best chance to do so.

The problem is that I’m not so sure McNabb is in that same position anymore.

Even though he’s only 33 (34 in November), McNabb has become a one-dimensional quarterback. Not only are his days of trying to be Vince Young over, his days of even channeling that spirit once in a blue moon are over.

Barring the 2005 season he missed almost half of, McNabb had a career-low 140 rushing yards last season. That comes on the heels of 2008, when he set his previous career low: 147.

Okay, so had he not missed two-and-a-half games due to injury and time in others due to the Wildcat, chances are he would’ve gotten eight more yards, but the point remains that the days of him being a threat to run in any situation are over.

Sure, a career rap sheet including a broken ankle, a torn ACL, a sports hernia, and broken ribs on a touchdown carry will do that to you.

But what inspires more confidence out of your quarterback: him scrambling to try and make something happen, or him throwing a ball at a receiver’s feet because he doesn’t want to try?

If McNabb won’t (or can’t) move, he becomes a pocket passer—and as good of a quarterback as McNabb is, he’s NEVER been a straight pocket guy.

So if the only attribute he brings to the table that Kevin Kolb doesn’t is experience, why not make a change?

Kolb has good size (6’3”, 220 lbs.), great arm strength (which means he can hit DeSean Jackson and Jeremy Maclin on those long routes), and is an adequate runner for someone his size—which isn’t any worse than McNabb at this point.

Plus, he’ll barely be 26 this season, which fits in with the youth movement on offense. After McNabb, the only other offensive player on the roster—lineman or skill—who has seen his 30th birthday as of March 1 is Kevin Curtis.

With Leonard Weaver (28 in September), Jason Avant (27 in April), Brent Celek (25), Jeremy Maclin (22 in May), and LeSean McCoy (22 in July) under contract for at least three more years and DeSean Jackson next in line for an extension, it would make sense to plug in the younger quarterback.

Give this team a season to grow—and it may take that, as Aaron Rodgers and the Packers proved—and they could have something special.

Otherwise, when 2013 comes along and most of that core is in or approaching their walk years, they’ll be looking at an offense with a 36-year-old signal-caller rapidly becoming a shell of his former self.

Makes sense, no?

And hey, if the Birds do this and stink in 2010, they at least have the uber-exciting Michael Vick (who is only going to be 30 himself) waiting in the wings and can look for a franchise passer in 2011.

In conclusion, if the Eagles can get any high-round pick or more for McNabb, now might be the time, when he still has a few good years left in him but not enough to still be the cornerstone of the franchise.

Teams will bite—just ask Brett Favre.

Last night on Kell on Earth, the People’s Revolution team wrapped up London Fashion Week with a Flintstone-themed Jeremy Scott show. Meanwhile, Stefanie Skinner and the two Andrews freaked out across the pond awaiting the senior staff’s return — and with good reason. With one less Stefanie to berate (reminder: Queen Dolt Stephanie Vorhees got fired last week), Emily takes her frustration out on Skinner every chance she gets and even causes her to cry ... INDOORS! Kelly explains that they are bitches to Skinner because they want to empower her. “People think that I’m hard on Skinner,” she says. “I love Skinner a lot. And I’m trying to train Skinner to be a winner.”

In any case, Emily and Skinner hug it out after solving a conundrum involving lack of tequila at a tequila-sponsored party. But really all of this is pretty boring compared to the tales Kelly shares about the good ol’ days — the nineties, of course — while "writing" her book with co-author Meredith Bryan. “When I moved to New York I had no clue,” she reminisces. “I floated into New York City in 1987 in a red Toyota Corolla with a check from my father for $2,000, who cried his eyes out and said, ‘Are you kidding me? You will never live in that hellhole.’ But when I got there, I was honest and I worked hard. And one thing led to another and I got a job as an assistant at a PR company and the next thing you know, I’m walking Michael Jackson through the Palladium.” And the next thing we know, we get this wonderful reality show. Now off to the Hierarchy of Personality Traits!

HOOKERS
• Kelly, for doling out overly gushy compliments about her client Jeremy Scott. “[He’s] an avant-garde designer who is also a great pop artist in his own right,” she says before also labeling him “badass,” “brave,” and “fun and powerful and theatrical; he’s entertaining and he’s a genius.” All of this while he sends a cutout tiger-print swimsuit down the runway with a tail attached.
• Cole, the green-haired Jeremy Scott model, who whips his hips around for Emily while imagining his sarong coming undone and his junk swinging back and forth on the runway.
• Kelly, for having the cameras follow her into the Babeland sex-toy shop, where she explains she’s buying the 47-year-old receptionist in her doctor’s office, who hasn’t had sex in nine-and-a-half years, her first vibrator. She also decides to get Andrew S. a tube of $28 lube. “I do a lot of kooky things just to try to keep the spirit going at People’s Revolution,” she says. “As a surprise, I’m getting Andrew a special little gift for his blind date.”
• Kelly, for trying to whore out Andrew M. to “some tank mustache stud” (his words) who they see riding a bike in front of their office. He ends up not being gay, but that’s after Kelly’s already invited him to come back to their office sometime to show her and Andrew his artwork (he also ends up being a musician, not an artist).

BITCHES
• Kelly, for yelling “Don’t you dare do that without my approval” at the Jeremy Scott lights guy in front of everyone involved with the show. “It’s my job to sit there and basically bang him over the head into submission to do what I want. Because it’s the designer’s show, it’s not the light-guy show.” Although we’re pretty sure Scott hired the lights guy just like he hired People’s Rev, and by “the designer’s show,” we’re pretty sure Kelly really means “my show!”
• Robin, the soulless slave master, who screams to Skinner, “Can I have that list that I sent to you???” while Skinner is telling Kelly (who is helping her prioritize) the exhaustive list of things she has to do. Even Kelly has to call Robin out on it.
• Emily, basically every time she talks to Skinner. Example: Emily: “It’s just like get it done. I don’t get what the delay is with everything.” Skinner: “The delay is that it’s one person working on everything.” Emily: “I need you to look at me and not look at your computer right now.” No wonder she gets nothing done!

EGOMANIACS
• Kelly, for wearing some awful eagle-printed tee to the Jeremy Scott show. And:
• Andrew M. for wearing horrendous red pleat-front printed shorts over below-the-knee bike shorts and a black vest over a grubby white tank top. That shit takes balls.
• Kelly, who uses her gig as a consultant to the British Fashion Counsel to rip apart a young designer’s collection, which she previously says is awesome. “These don’t make any sense with the rest of what you’re doing,” she says while clearing away all of the jewelry the designer has set out. “A collection is like a sentence. It’s not a life story. These don’t make sense in your story [snatches up the bangles]. Don’t do sh— you can get on the street for five bucks.” Emily calls the scene “embarrassing.”
• Kelly, when describing her life in New York circa 1991. “The only thing I had to do was work and party. This was the last part of the last great club world. We woke up, we worked, we all went to dinner and we all went clubbing till 3 or 4 in the morning, every night. We were young, we were rich, we were shallow, we were skinny, we were pretty, we were powerful, we were well-connected.” And now?
• Kelly and her assistant Andrew M., for crashing Andrew S.’s first date in a year and a half. “Andrew and I were thinking of what we could do to entertain ourselves, which was to crash Serrano’s date,” explains Kelly. “I don’t think he thought it was so funny. But we didn’t really care what he thought anyway.” Then she got miffed when Andrew S. and date didn’t ask about how her day was.
• Kelly: “We meet everybody’s dates at People’s Revolution. We do the stuff brothers and fathers used to do but don’t seem to do anymore. We make that pretty clear to all of the love interests at People’s Revolution, that we are looking out for them. And if these people play tricks on any of our kids, they are in trouble.” Fashion Mafia, much?
• Kelly, for stating the obvious to Skinner. “I just want to say that I’m the most important person in this company and what I need should be a priority.” Um, yep. Got that part already.
• Kelly, when she explains how huge it is that she got Mary Ellen Mark to shoot her book cover. “One of the most important living photographers in the world agreed to shoot my book cover.
